Terms of Service

These Terms of Service ("Terms") govern your access to and use of VieBonne (the "Platform"), which is owned and operated by Voirtech Inc., a Florida C Corporation located at 332 Pinestraw Circle, Altamonte Springs, FL 32714, USA ("Voirtech," "VieBonne," "we," "us," or "our").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

If you use business features, the Business Client Terms of Service also apply in addition to these Terms.

We may modify these Terms at any time. Your continued use of the Platform after changes constitutes acceptance of the updated Terms.

Our Privacy & Cookies Notice explains how we collect, use, and share information. By using the Platform, you agree to that notice.

If you choose to provide optional medication or health-related information, you consent to its use for food interaction guidance and personalization. You may withdraw consent at any time by removing that information or contacting us.

You must be at least 13 years old to use the Platform. If you are under 18, you may use the Platform only with the consent of a parent or legal guardian.

• You are not barred from using the Platform under applicable laws.
• You will comply with all laws and regulations that apply to your use of the Platform.

You acknowledge and agree that:

• You use VieBonne entirely at your own risk and discretion
• Individual nutritional needs vary significantly based on age, health status, medical conditions, allergies, medications, and other factors
• AI-generated meal plans and nutritional recommendations may not be suitable for your specific situation
• You are solely responsible for verifying the accuracy and appropriateness of any information before use
• Food allergies and dietary restrictions are serious matters requiring professional medical guidance

We may offer paid subscriptions, add-ons, or usage-based features (for example, additional AI usage).

• Pricing, billing terms, and feature limits are shown at the time of purchase.
• Subscriptions renew automatically unless you cancel before the end of the billing period.
• You can cancel at any time; access continues through the current paid period.
• Fees are non-refundable except where required by law.
• Taxes may apply based on your location.
• We may change prices or plans with advance notice.
• Trials convert to paid subscriptions unless canceled before the trial ends.
• EEA/UK residents may have a 14-day withdrawal right for digital services unless waived at checkout.
• Unused AI credits or usage allowances are not refundable.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

VieBonne explicitly disclaims all warranties, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Any warranty regarding the accuracy, completeness, reliability, or timeliness of content
• Any warranty that the Platform will be uninterrupted, secure, or error-free
• Any warranty regarding the results obtained from using the Platform

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIEBONNE, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER.

This includes but is not limited to:

• Direct, indirect, incidental, special, consequential, or punitive damages
• Personal injury, illness, allergic reactions, or adverse health effects
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from reliance on nutritional information or meal plans
• Damages from food allergies, dietary restrictions, or medical conditions
• Damages from third-party content, products, or services (including deals and promotions)
• Unauthorized access to or alteration of your data
• Any other matter relating to the Platform or services

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if VieBonne has been advised of the possibility of such damages.

IF YOUR JURISDICTION DOES NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU, BUT OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

You agree to indemnify, defend, and hold harmless VieBonne, its owners, officers, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

• Your use of the Platform
• Your violation of these Terms of Service
• Your violation of any third-party rights
• Any content you submit or post on the Platform
• Any health issues, allergic reactions, or adverse effects related to your use of the Platform
• Any decisions you make based on information obtained through the Platform

VieBonne displays or links to third-party content, promotions, or services. You acknowledge that:

• VieBonne is not responsible for the accuracy, availability, or terms of third-party content or deals
• Third parties are solely responsible for their products or services
• Your interactions with third parties are solely between you and them
• VieBonne is not liable for any issues arising from third-party transactions

Users may submit recipes, reviews, and other content. By submitting content, you:

• Grant VieBonne a non-exclusive, worldwide, royalty-free, sublicensable license to host, use, modify, reproduce, distribute, display, and create derivative works from your content
• Represent that you own or have the right to submit the content
• Acknowledge that VieBonne is not responsible for user-generated content
• Acknowledge that nutritional information in user recipes may be inaccurate
• Agree that VieBonne may remove any content at its discretion without notice

The Platform, including software, designs, trademarks, and content, is owned by Voirtech or its licensors.

• We grant you a limited, revocable, non-transferable license to use the Platform for personal, non-commercial use.
• You may not copy, modify, distribute, sell, rent, reverse engineer, or exploit any part of the Platform unless expressly authorized.
• VieBonne and Voirtech trademarks may not be used without our prior written consent.

We respect intellectual property rights and respond to notices of alleged infringement.

• Notices should be sent to admin@voirtech.com with a description of the work, the allegedly infringing material, and your contact information.
• Include a statement that you have a good faith belief the use is not authorized and that the information is accurate under penalty of perjury.
• We may remove or disable access to content and may terminate repeat infringers.

Nutritional information on the Platform is provided for general informational purposes only:

• Nutritional data may be sourced from USDA databases, user input, or AI estimation
• Accuracy cannot be guaranteed and may contain errors or omissions
• Serving sizes, ingredients, and preparation methods affect actual nutritional content
• Individual products may vary from displayed nutritional information
• You should verify nutritional information independently if accuracy is critical to your health

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• The accuracy of information you provide to the Platform

You agree not to:

• Use the Platform for any illegal purpose
• Violate any laws, regulations, or third-party rights
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to the Platform
• Interfere with or disrupt the Platform's operation
• Use automated systems to access the Platform without permission
• Impersonate others or provide false information
• Harass, abuse, or harm other users
• Scrape, crawl, or index the Platform without written permission
• Reverse engineer or circumvent security or access controls

Community, chat, and social features are provided as a convenience. We do not endorse user content and are not obligated to monitor it.

• You are responsible for your interactions with other users.
• We may remove content or suspend accounts that violate these Terms or community standards.

You may not use the Platform if you are located in a country or region subject to U.S. sanctions or if you are on any prohibited or restricted list.

• You agree to comply with all applicable export control and sanctions laws.

VieBonne reserves the right to:

• Suspend or terminate your access to the Platform at any time without notice
• Remove any content at our discretion
• Modify or discontinue the Platform or any features without liability

Upon termination, your right to use the Platform immediately ceases. Sections of these Terms that by their nature should survive termination shall survive.

These Terms shall be governed by and construed in accordance with the laws of the State of Florida and applicable U.S. federal law, without regard to conflict of law principles.

ARBITRATION AGREEMENT: Any dispute arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration administered by JAMS in Orange County, Florida, except that you may assert claims in small claims court if they qualify. You waive your right to a jury trial and to participate in class actions.

OPT-OUT: You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing admin@voirtech.com with the subject line "Arbitration Opt-Out" and your account email.

If you reside in the EEA or UK, nothing in this section limits your mandatory consumer rights, and you may bring claims in your local courts where required by law.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

These Terms constitute the entire agreement between you and VieBonne regarding the use of the Platform and supersede all prior agreements and understandings.
